These Terms and Conditions govern use of the Town of Kiowa, Oklahoma website and participation in SMS/text messaging services provided by the Town of Kiowa, Kiowa Municipal Court, and Kiowa Police Department.
By using the Town's website, users agree to the website provisions contained in these Terms.
Participation in the Town's SMS messaging program is separate, optional, and requires affirmative consent as described below.
The Town's website is provided as a public information resource.
The Town makes reasonable efforts to provide accurate and current information but does not guarantee that every webpage, document, calendar entry, fee, deadline, court date, ordinance, or other item displayed online is complete or error-free.
Official Town records, court records, ordinances, orders, citations, and other official documents control in the event of a conflict with information appearing on the website.
The Town of Kiowa provides an optional SMS/text messaging program to assist individuals with communications involving the Town, Kiowa Municipal Court, and Kiowa Police Department.
Messages are informational and transactional in nature and are directly related to the recipient's interaction with the Town.
The Town does not use this program to send third-party advertising or commercial marketing messages.
Individuals who voluntarily opt in may receive messages concerning:
Participation in the SMS program is voluntary.
A person may opt in through an affirmative verbal, written, electronic, or other approved consent process.
For example, a Kiowa Police Department officer, municipal court employee, or other authorized Town employee may ask an individual whether the individual wishes to receive citation or court-related communications by text message.
Before obtaining verbal consent, the individual may be informed that:
The individual must affirmatively agree before being enrolled in recurring SMS communications.
Simply providing a telephone number to a Town employee, municipal court employee, or Kiowa Police Department officer does not, by itself, constitute consent to participate in the Town's recurring SMS messaging program.
Declining SMS messages will not prevent an individual from:
When an individual affirmatively agrees to electronic or SMS delivery, the Kiowa Police Department or Municipal Court may provide citation information or a copy of a citation by text message.
Electronic delivery is provided as a convenience.
Receiving a citation by text does not alter the legal obligations contained in the citation or any applicable law, court order, or court procedure.
The Town may send reminders concerning court appearances, unresolved citations, failures to appear, payment obligations, or other court-related matters to individuals who have opted in.
These messages are intended as an additional courtesy and communication method.
A text message does not replace any notice, service, summons, citation, court order, mailing, or other procedure required by law.
Failure to receive, read, or respond to a text message does not excuse a person from:
When applicable, SMS messages may contain information or warnings concerning possible driver's license suspension, referral to another governmental agency, issuance of process, additional costs, or other consequences associated with an unresolved citation, failure to appear, or court matter.
Such messages are informational.
The existence, timing, or legal effect of any driver's license action or other enforcement action is governed by applicable law and official governmental or court records, not by the SMS message itself.
Message frequency varies depending upon the recipient's citation, court matter, request, or interaction with the Town.
Some individuals may receive only one or two messages, while others may receive additional messages when necessary for their particular matter.
Message and data rates may apply.
Charges, if any, are determined by the recipient's wireless carrier and service plan.
The Town does not charge a separate subscription fee for participation in the SMS program.
A recipient may stop recurring SMS messages at any time by replying:

A confirmation message may be sent acknowledging the opt-out request.
After opting out, the recipient will no longer receive recurring messages through that SMS program unless the recipient subsequently provides new consent.
Opting out of SMS communications does not cancel or modify any citation, case, court date, payment obligation, warrant, driver's license action, court order, or other legal obligation.

SMS delivery depends upon wireless carriers, telecommunications networks, Internet connectivity, equipment, software, and other systems outside the Town's direct control.
The Town does not guarantee that every message will be delivered, received, or received within a particular period of time.
Wireless carriers are not liable for delayed or undelivered messages.
Individuals remain responsible for complying with citations, court dates, court orders, payment deadlines, and other legal requirements regardless of whether an SMS message is successfully delivered.
Recipients are responsible for notifying the Town when a mobile number associated with their matter is no longer valid or no longer belongs to them.
A person who acquires a telephone number previously used by another person should reply STOP if that number receives unwanted Town messages.
The Town's collection and use of information associated with SMS messaging is governed by the Town of Kiowa Privacy Policy.
Mobile telephone numbers, SMS opt-in information, and SMS consent information will not be sold, rented, or shared with third parties or affiliates for marketing or promotional purposes.
Information may be provided to telecommunications providers, software vendors, contractors, or other service providers solely as reasonably necessary to operate and support the Town's SMS messaging services.
The Town's SMS program is intended for governmental, court, public-safety, administrative, and informational communications.
The Town will not use consent obtained for this program to authorize unrelated marketing or promotional messages from third parties or affiliates.
SMS consent is specific to the Town of Kiowa messaging program and is not transferable to another business or organization for its marketing purposes.
The SMS program is not an emergency reporting or emergency dispatch system.
Do not send emergency requests by text message.

The Town cannot guarantee that replies to SMS messages will be monitored continuously or immediately.

Nothing in this section is intended to restrict lawful speech, lawful public records requests, lawful criticism of government, or other activity protected by law.
The Town's website or messages may contain links to third-party websites or services.
The Town is not responsible for the availability, content, security, privacy practices, or accuracy of third-party websites.
Use of third-party services is subject to the terms and policies of those providers.
Nothing contained in these Terms and Conditions is intended to waive, alter, expand, or diminish any defense, limitation of liability, governmental immunity, statutory protection, or other right available to the Town of Kiowa, its officials, employees, officers, agents, or representatives under applicable law.
The Town may revise these Terms and Conditions when necessary to reflect changes in law, Town operations, technology, court procedures, or telecommunications requirements.
The current version will be posted on the Town's website with its effective date.
Continued participation in SMS messaging after applicable notice of changes is subject to the revised Terms, except where additional consent is required by law or applicable messaging rules.
These Terms and Conditions are governed by applicable federal law and the laws of the State of Oklahoma.
Nothing in these Terms changes the jurisdiction, venue, authority, procedures, or legal requirements applicable to the Town of Kiowa or Kiowa Municipal Court.
