PRIVACY POLICY

The Town of Kiowa, Oklahoma ("Town," "we," "us," or "our") respects the privacy of individuals who use the Town's website, communicate with Town departments, provide contact information to Town employees, or participate in the Town's text messaging services.

This Privacy Policy explains how information may be collected, used, maintained, and disclosed by the Town, including information associated with the Town of Kiowa Municipal Court and Kiowa Police Department.

The Town may provide an optional SMS/text messaging service for individuals who voluntarily consent to receive messages.

The Town does not use this SMS program to send commercial advertising or third-party marketing messages.

Providing a mobile telephone number to a Town employee, court employee, or Kiowa Police Department officer does not, by itself, constitute consent to receive recurring SMS messages. SMS consent is obtained separately and voluntarily.

Individuals may consent through an affirmative verbal, written, electronic, or other authorized opt-in process.

Consent to receive SMS messages is not a condition of receiving Town services, resolving a citation, appearing in municipal court, obtaining police services, or otherwise conducting business with the Town.

4. MOBILE INFORMATION AND SMS CONSENT WILL NOT BE SOLD OR USED FOR MARKETING

The Town of Kiowa will not sell, rent, or share mobile telephone numbers, SMS opt-in information, or SMS consent information with third parties or affiliates for marketing or promotional purposes.

Mobile information and SMS consent information may be provided to contractors, telecommunications carriers, software providers, or other service providers only when reasonably necessary to operate, support, transmit, maintain, or secure the Town's messaging services.

Such service providers are permitted to use the information only as necessary to provide services to the Town and not for their own independent marketing or promotional purposes.

SMS opt-in information and consent are not transferred to other organizations for their own marketing campaigns.

5. MESSAGE FREQUENCY AND CHARGES

Message frequency varies based upon the individual's citation, court matter, request, or interaction with the Town.

Message and data rates may apply according to the recipient's wireless carrier and service plan.

The Town does not charge a separate fee for participating in the SMS program.

6. OPTING OUT OF TEXT MESSAGES

Recipients may opt out of SMS messages at any time by replying:

After an opt-out request is processed, the recipient will no longer receive recurring SMS messages from that messaging program unless the recipient later provides new consent as permitted by law and applicable messaging requirements.

Opting out of SMS messages does not cancel or modify a citation, court date, court order, payment obligation, warrant, driver's license action, or other legal requirement.

8. SHARING INFORMATION FOR GOVERNMENTAL OR LEGAL PURPOSES

Except for the SMS marketing restrictions stated above, information maintained by the Town may be disclosed when reasonably necessary:

Records maintained by a governmental entity may be subject to applicable public records, records-retention, court-record, law-enforcement-record, and confidentiality laws.

Nothing in this Privacy Policy is intended to require disclosure of information that is confidential, privileged, protected, or otherwise exempt from disclosure under applicable law.

The Town retains records for periods reasonably necessary to perform governmental functions and as required by applicable federal law, Oklahoma law, court rules, municipal record-retention requirements, litigation holds, or other legal obligations.

SMS consent records and related communications may be retained to document consent, communications, opt-out requests, and compliance with applicable requirements.

10. SECURITY

The Town takes reasonable administrative, technical, and physical measures intended to protect information under its control.

However, no website, electronic communication, text message, wireless network, or electronic storage system can be guaranteed to be completely secure.

Individuals should not send Social Security numbers, financial account numbers, medical information, passwords, or other highly sensitive information by SMS unless specifically instructed to do so through an authorized secure method.

11. THIRD-PARTY SERVICES AND LINKS

The Town's website may contain links to websites or services operated by third parties.

The Town is not responsible for the privacy practices, security, accuracy, or content of third-party websites or services.

Individuals should review the privacy policies of those services before providing personal information.

12. TEXT MESSAGES ARE NOT AN EMERGENCY SERVICE

The Town's SMS messaging system is not monitored or intended for emergency communications.

Do not use text messaging to report an emergency. Call 911 for emergency police, fire, or medical assistance.

13. CHANGES TO THIS PRIVACY POLICY

The Town may update this Privacy Policy from time to time to reflect changes in law, technology, Town operations, or messaging requirements.

The current version will be posted on the Town's website with the applicable effective date.
